Badgers and their setts are protected by the Protection of Badgers Act (1992).
Implications for Development
Mitigation for any development within distance of a badger sett may require mitigation for badgers.
Badger presence / absence surveys are possible throughout the year, however, autumn and spring are best, when vegetation is sparse enough to locate setts and badgers are still active. Infra-red cameras may also be used to assess if badgers are using a sett.
Mitigation & Compensation
Badger setts can be closed, damaged or disturbed under a badger Development Licence, issued by Natural England. Works affecting badgers setts can only be completed between July and November, which is outside the breeding season.
